One Granted Bail & One Awaits Sentence

Thirty years old Joseph Yamba, a businessman, and twenty seven years old Mohamed Kargbo, a Chief, made another appearance before Magistrate Mustapha Braima Jah of Pademba Road Court No.1 on two count charges, to wit: conspiracy to commit a crime contrary to law, and Larceny contrary to section 2 of the larceny Act of 1916.
According to the particulars of offence, on Monday 26th January 2026 at Chapter One Club area, Beach Road, Lumley in the western area of Freetown, conspired together and with other persons unknown to commit a crime, to wit: Larceny.
Count two further stated that on the same date and place both defendants with intent, did steal from Mohamed Lebbie one iphone 16 promax and other assorted items, all to the total value of seventy five thousand three hundred and thirty Leones (75,330), property of Mohamed Lebbie
When the charges were read and explained to the defendants, the first pleaded not guilty and the second pleaded guilty.
Prosection Witness Number One, DPC 11686 Yayah Jabbie, attached at the Criminal Investigation Department, Lumley Police Station, recognized the complainant and defendant in this matter.
He recalled on the 5th February 2026, whilst on duty, himself and inspector Kamara I.S brought the first defendant and made report of Larceny, where a black power bank was presented as exhibit, which the complainant alleged that it was one of the stolen property. On the same date he obtained voluntary caution statement from the first defendant, where he later mentioned the second defendant, who was arrested and brought to the station.
He furthered that together with inspector I.S Bangura they obtained voluntary caution statement from the first defendant in krio which he recorded in English, and at the conclusion of the statement, it was read over and explained to the first defendant who.then admitted it to be true and correct by affixing his right hand thumb print, witnessed by the said investigator and he signed as the recorder
He explained that on the 11th February 2026 a request was sent to the DPP for the first defendant
On the 5th, 16th and 26th February 2026, himself and sergeant 8773 Bangura F.B charged the defendant with the offence he is standing trial on by using the same procedure as in his voluntary caution statement. The charge statement was produced and tendered in court to formed part of the court records.
On the 6th February 2026 search warrant was endorse at the premises of the first defendant during the search warrant different national identity cards was found which was retriever as exhibit the search warrant was signed by the first defendant girlfriend and the second defendant the said search warrant was produce and tender in court to formed part of to court records
The Defense Counsel M.B Bah sought for a short adjournment date.
Meanwhile, Magistrate Jah remanded the second defendant at the male correctional facility in Freetown for sentencing, while the first defendant was granted bail in the sum of two hundred and fifty thousand Leones with one surety in like sum, and surety must be a Sierra Leonean resident in Freetown, surety to produce valid identify card and bail to be approved by the Deputy Assistant Registrar. The matter was adjourned to the 16th April 2026.
