Defense Serves Court With No-Case Submission

Businessman, Mohamed Nicole, has made another appearance before Magistrate John Manso Fornah at Pademba Road Court No. 2 in Freetown on a charge of obtaining money by false pretences, contrary to Section 32(1) of the Larceny Act of 1916.
According to the indictment, the accused allegedly, in November 2025, at Juba Hill, Freetown, with intent to defraud, obtained Le27,000 from Fatmata Kamara by falsely claiming that he would secure a Canadian visa and facilitate the travel of the complainant’s son, Foday Mohamed Lamin Kamara, to Canada, knowing the representation to be false.
At the previous hearing, the prosecution informed the court that it intended to close its case.
When the matter resumed, defence counsel served the court with a no-case submission, arguing that the prosecution had failed to establish a prima facie case against the accused.
In response, the prosecutor requested an adjournment to enable the prosecution to file its reply to the defence’s no-case submission.
Magistrate John Manso Fornah granted the application and adjourned the matter to 27 July 2026 for further hearing.
